North Cyprus Buyer’s Guide

Your Guide to Buying Property in North Cyprus

Buying property in North Cyprus can be an exciting experience, whether you are searching for a permanent home, holiday property, retirement property or investment.

However, buying property in another country is a major financial commitment. Understanding the process, obtaining independent legal advice and carrying out the correct checks before committing to a purchase are extremely important.

Buy in North Cyprus works in association with BusyBees Real Estate, an established estate agency with over 20 years’ experience and offices across North Cyprus.

This guide provides an introduction to the buying process and some of the important points you should consider.

1. Decide What You Are Looking For

Before viewing properties, it helps to establish your priorities.

Consider:

• Your overall budget
• Apartment, villa, bungalow, penthouse or land
• New-build or resale property
• Permanent home, holiday home or investment
• Preferred location
• Distance from the sea
• Swimming pool and communal facilities
• Maintenance costs
• Rental potential, if relevant
• Payment plan or completed property
• Title-deed status

Once we understand your requirements, we can narrow the search and show you properties that genuinely suit your needs rather than wasting your time viewing unsuitable properties.

2. Choosing the Right Area

North Cyprus offers very different locations and lifestyles.

İskele & Long Beach

Popular for modern developments, apartments, holiday properties and investment opportunities, with extensive facilities and easy access to the coastline.

Esentepe

Known for spectacular sea and mountain views, villas, apartments, resort developments and its proximity to the golf course and coastline.

Kyrenia & Alsancak

Established residential areas offering villas and apartments with convenient access to Kyrenia, restaurants, shops, schools and other amenities.

Famagusta & Yeni Boğaziçi

Popular for family homes, villas, apartments and land, with access to Famagusta, universities, beaches and established residential communities.

We recommend spending time in different areas before making your final decision.

3. Viewing Properties

Photographs and videos are useful for creating a shortlist, but wherever possible we recommend viewing the property and surrounding area personally before making a final decision.

During a viewing, consider more than simply the property itself.

Look at:

• The surrounding area
• Road access
• Nearby construction
• Views and whether they could potentially change
• Distance to shops and amenities
• Communal facilities
• Maintenance charges
• Parking
• Property condition
• Development completion status
• Title-deed position

For resale properties, you should also consider what furniture, appliances and other items are included in the sale.

4. Make an Offer

Once you find the right property, an offer can be made to the seller.

The offer should clearly establish the proposed purchase price and any important conditions.

These might include:

• Furniture and white goods
• Completion date
• Payment schedule
• Items included with the property
• Repairs or outstanding work
• Whether the property is being sold furnished
• Any other conditions agreed between buyer and seller

Once the price and basic terms are agreed, the legal process can begin.

5. Use an Independent Lawyer

We strongly recommend that every buyer appoints an independent lawyer experienced in North Cyprus property transactions.

Your lawyer acts for you—not the estate agent, developer or seller.

Among other things, your lawyer can:

• Review the proposed purchase
• Check ownership documentation
• Carry out relevant property searches
• Check for registered mortgages, charges or other encumbrances
• Review or prepare the Contract of Sale
• Explain your legal obligations
• Register the contract where applicable
• Assist with Permission to Purchase
• Deal with completion and transfer of title

Legal fees vary according to the lawyer and complexity of the transaction, but buyers should normally allow approximately £2,000 as a working estimate for standard legal representation.

Always obtain a written quotation directly from your chosen lawyer.

6. Reservation Deposit

A reservation deposit may be requested once you have selected a property and agreed the basic terms.

The purpose is normally to reserve the property while the legal work and Contract of Sale are prepared.

Before paying a reservation deposit, make sure you understand:

• How much you are paying
• Who will hold the money
• Whether it is refundable
• Under what circumstances it can be retained
• How long the property will be reserved
• Whether the amount forms part of the purchase price

Do not assume that every reservation deposit is refundable.

7. Property Searches and Legal Checks

Before proceeding with the purchase, your lawyer should advise you regarding the appropriate searches and checks.

Depending on the property, these may include checking:

• Registered ownership
• The title deed
• Mortgages
• Charges
• Encumbrances
• Planning matters
• Building permissions
• Contractual obligations
• Relevant site or development documentation

The checks required can differ between a completed resale property, a property under construction and an off-plan development.

8. Understanding Title Deeds

Title deeds are an important part of buying property in North Cyprus.

Different properties can have different title histories and legal circumstances. Buyers should not rely simply on an estate-agent description of the title.

Your independent lawyer should examine the documentation relating to the specific property you intend to purchase and explain the position to you before you become legally committed.

Buy in North Cyprus and BusyBees Real Estate market selected properties, but the final legal assessment of any title should always be undertaken by the buyer’s independent lawyer.

9. Contract of Sale

Once the legal checks are satisfactory and the terms have been agreed, the Contract of Sale can be prepared.

The contract should clearly state matters including:

• Buyer and seller details
• Property details
• Purchase price
• Deposit paid
• Payment schedule
• Completion arrangements
• Items included in the sale
• Obligations of the buyer
• Obligations of the seller
• Any agreed special conditions

For an off-plan or property-under-construction purchase, the contract may also deal with matters such as construction specifications, completion dates, communal facilities and handover arrangements.

Your lawyer should explain the contract to you before you sign it.

10. Registering the Contract

Following signing, the Contract of Sale should be dealt with in accordance with the applicable Land Registry requirements.

Registration is an important stage of the buying process and applicable duties and fees may become payable.

Your lawyer should explain the current registration procedure, deadlines and charges applicable to your particular purchase.

11. Permission to Purchase

Foreign nationals purchasing property in North Cyprus are generally required to obtain the appropriate Permission to Purchase.

Applications are handled through the relevant authorities and can normally be submitted by the purchaser or through their lawyer or authorised representative.

Documents may include:

• Passport or identification
• Property/title-deed documentation
• Site/location plan
• Purchase contract where applicable
• Criminal-record documentation
• Application information required by the authorities

The exact requirements can change, so your lawyer should confirm what is required when your application is made.

As a working estimate, buyers should allow approximately £500 for assistance and costs connected with a standard Permission to Purchase application, but the actual amount should be confirmed with your lawyer.

12. Foreign Buyer Ownership Rules

North Cyprus has specific rules governing property ownership by foreign nationals.

These rules can determine the number and type of properties that a foreign purchaser may acquire and can include restrictions relating to land area, property type and location.

The legislation has changed in recent years and further amendments are possible.

For this reason, buyers should obtain current legal advice concerning their nationality and intended purchase rather than relying on older information found online.

13. Purchase Taxes and Additional Costs

The purchase price is not the only cost involved when buying property.

Depending upon the property and transaction, additional costs can include:

• Legal fees
• Permission to Purchase costs
• Stamp duty
• Contract-registration charges
• Land Registry/transfer fees
• VAT where applicable
• Utility connection charges
• Development or infrastructure charges on some new properties
• Communal maintenance fees
• Property insurance
• Other transaction-specific charges

The amount payable can vary according to the property, seller, purchaser, title position and legislation in force at the time of the transaction.

Before signing a contract, ask your lawyer for a written breakdown of the anticipated purchase costs.

14. Example Budget

If you are considering a property priced at £150,000, your budget should not simply be £150,000.

For example, you may need to allow for:

Property purchase price: £150,000
Independent lawyer: approximately £2,000
Permission to Purchase: approximately £500
Plus: applicable taxes, Land Registry charges, registration costs, VAT where applicable and any property-specific charges.

We recommend establishing the estimated total acquisition cost before committing to a property.

15. Buying a New-Build or Off-Plan Property

Buying from a developer can provide advantages such as modern specifications, payment plans and a choice of units.

However, additional considerations may apply.

Before purchasing, establish:

• Developer details
• Construction status
• Expected completion date
• Payment schedule
• Property specification
• What is included in the purchase price
• Communal facilities
• Maintenance charges
• Utility and infrastructure costs
• Title-deed arrangements
• Contract protections if completion is delayed

Any advertised completion date should be treated as an anticipated date rather than a guarantee unless your legal agreement specifically provides otherwise.

16. Buying a Resale Property

A resale property can offer the advantage of seeing exactly what you are purchasing.

Before completing a resale purchase, establish:

• What furniture is included
• Which appliances are included
• Property condition
• Maintenance history
• Outstanding communal charges
• Utility position
• Title-deed position
• Any alterations or extensions to the original property

If additions have been made to the property, your lawyer should advise you regarding their legal and planning status.

17. Buying Land

Buying land requires additional consideration.

Before purchasing land, obtain professional advice regarding:

• Title and ownership
• Plot boundaries
• Access
• Planning permission
• Permitted building percentage
• Maximum construction allowance
• Infrastructure
• Electricity and water availability
• Road access
• Any planning restrictions affecting the land

Never assume that because a piece of land is advertised for sale you can automatically build the property you want on it.

18. Completion

The completion procedure will depend on the property and terms of your contract.

For a completed property, this can involve payment of the outstanding purchase balance, handover of possession and ultimately the transfer of title when the relevant legal requirements have been satisfied.

For a new-build property, handover and title transfer may occur at different times.

Your lawyer should explain the completion process applicable to your particular purchase.

19. Transfer of Title

Transfer of the title deed is an important legal stage and should be handled with your lawyer.

Before transfer, the relevant requirements, permissions, taxes and fees must be dealt with.

Do not assume that taking possession of the property and receiving the keys is the same thing as having the title deed transferred into your name.

They are separate matters.

20. Utilities and Running Costs

After purchasing a property, you may need to arrange or transfer services such as:

• Electricity
• Water
• Internet
• Property insurance
• Communal maintenance
• Pool maintenance
• Garden maintenance

Properties within developments may have monthly or annual maintenance charges. Ask for details before purchasing so you understand the ongoing cost of ownership.

21. Investment and Rental Property

Some buyers purchase property with the intention of generating rental income or achieving long-term capital growth.

Property investment always carries risk.

Rental demand, occupancy, property values, exchange rates, taxation and regulations can change.

Any rental projections or investment figures should therefore be regarded as indicative rather than guaranteed.

If investment is your priority, we can help identify properties that may suit your objectives, but you should make your decision based on your own circumstances and independent professional advice.

22. Before You Buy – Final Checklist
